I have read several articles recently in your publication stating that the Jamaica Anti-Doping Commission (JADCO) has sanctioned athletes and I am writing to point out that sanctions are imposed by the Jamaica Anti-Doping Disciplinary Panel (JADDP) and not JADCO.
In fact, the Jamaica Anti-Doping Disciplinary Panel, the Jamaica Anti-Doping Appeals Tribunal (JADAT) and the Jamaica Anti-Doping Commission (JADCO) are all independent entities, established by the Anti-Doping in Spot Act of 2008 and the commission does not have any legal authority to vary any penalty imposed by the Disciplinary Panel or the Appeals Tribunal.
The Jamaica Anti-Doping Disciplinary Panel is responsible for determining sanctions handed down to athletes, or other persons, for committing anti-doping rule violations. The two major bodies with the power to overrule sanctions imposed by the Disciplinary Panel are:
* The Jamaica Anti-Doping Appeals Tribunal (JADAT); and
* The Court of Arbitration for Sport (CAS).
As outlined in the Anti-Doping in Sport Act of 2008, JADCO is responsible for executing the national anti-doping programme in accordance with the standards stipulated by the international governing body, the World Anti-Doping Agency (WADA).
JADCO ensures that all athletes comply with the World Anti-Doping Code, which is the document that harmonises regulations regarding anti-doping across all sport and in all countries around the world. The main functions of JADCO include the deterrence of doping through communication and education initiatives, detection of doping through testing activities and investigations and the enforcement of anti-doping rules by presenting cases of possible anti-doping rule violations to the Jamaica Anti-Doping Disciplinary Panel.
JADCO remains committed to the fight against doping in sport, as it continues to ensure that all stakeholders are provided with the requisite information to assist them to make sound decisions.
